NOTICE OF CONFIRMATION OF AN ORDER PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER
HIGHWAYS ACT 1980, S.119 WILDLIFE AND COUNTRYSIDE ACT 1981, SECTION 53A (2)
The Borough of Blackburn with Darwen FP's 207 and 211(part) FP 212(part), Darwen Diversion Order 2022
On 15th December 2022 Blackburn with Darwen Borough Council I confirmed the above order made under section 119 of the Highways Act 1980 ("the Act") and section 53(A)(2) of the Wildlife and Countryside Act 1981. The effect of the order as confirmed is to divert the public footpath as described in Schedule 1 to this Notice onto the route described in Schedule 2 and as shown on the Order Map.
A copy of the Order and Map may be examined at the Public Notice Boards outside Blackburn Town Hall and Darwen Town Hall free of charge. Copies of the Order may be purchased at the price of 50p, please make a request to Public.RightofWay@blackburn.gov.uk.
The order comes into force following 28 days from the date of this notice, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from the date of this notice, make an application to the High Court.

SCHEDULE 1 - LINE OF EXISTING ROUTE
Footpath 207 Darwen.
From the junction of FP209 & FP155 Darwen at the Old Weir at Jack Key's (SD 70442 20426) to Cranberry Lane at Point I (SD 70543 20688), a length of approximately 290m in a generally North-North-Easterly I direction via points K (SD 70460 20455) and G (SD 70446 20563). The | full length of the footpath is to be stopped up.
Footpath 211 Darwen.
From FP208 at Point H (SD 70473 20508) in a generally North-Westerly
direction for approximately 772m via Points G, F (SD 70324 20663), Kirkhams Farm (Points E (SD 70315 20678), B (SD 70289 20729) & A (SD
70266 20788)) to Watery Lane (SD 70012 20960). The sections of
footpath to be stopped up are the lengths between Points H-G-F and Points E-B-A.
Footpath 212 Darwen.
From Kirkhams Farm (Point B) in a North-Easterly Direction for approximately 200m to Cranberry Lane at Point D (SD 70416 20860) via Point C (SD 70312 20731). The section of footpath to be stopped up | is the length between Points B-C.
SCHEDULE 2 - LINE OF DIVERSIONARY ROUTE
Footpath 207 Darwen.
A path 1.8m wide from FP208 at Point P (SD 70545 20489) in a generally North-Westerly direction to Point M (SD 70467 20572) and then in a generally North-Easterly direction to Cranberry Lane at Point L (SD 70562 20662) a length of approximately 247m.
Footpath 211 Darwen.
A path 1.8m wide from FP208 at Point K (SD 70460 20455) in a
generally North-Westerly direction via Points F, Kirkhams Farm (Points E-C-A) to Watery Lane, a total distance of approximately 730m.
Footpath 212 Darwen.
A path 1.8m wide from Kirkhams Farm at Point C in a North-Easterly Direction for approximately 177m to Cranberry Lane at Point D.
