Footpath 123 (Part) Blackburn Public Path Diversion Order 2021
On 9th September 2021 Blackburn with Darwen Borough Council confirmed without modifications the above order made under section 119 of the Highways Act 1980.
The effect of the order as confirmed is to divert the public footpath as described in Schedule 1 to this Notice onto the route described in Schedule 2 and as shown on the Order Map. A copy of the Order and Map may be examined at the Public Notice Boards inside Blackburn Town Hall and Darwen Town Hall free of charge. Copies of the Order may be purchased at the price of 50p, please makearequesttePublicRightofWay@BLACKBURN.GOV.UK. The order comes into force on 9th September 2021, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act as amended, or of any regulation made under the Act has not been complied with in relation to the order he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 9th September 2021 make an application to the High Court. SCHEDULE 1 - LINE OF EXISTING ROUTE
Public footpath 123 Blackburn is to be diverted as shown on the attached plan. Public footpath 123 Blackburn runs from Point A (SD 69478 24701) in an westerly then southerly then westerly direction for approximately 115m under the railway to Point C (SD69402 24658), shown as a dashed line on the attached plan. The route continues in a north westerly direction for 516m down the previous line of Milking Lane to Point E (SD 69003 24961) shown as a solid bold line.
SCHEDULE 2 - LINE OF DIVERSIONARY ROUTE
The proposed diversion route is shown on the attached plan B-A-C-D-F-G-H-l. From Point B (SD69509 24707), the diversion route will follow an existing 2m wide footpath running westerly for approximately 32m to point A (SD69478 24701) shown as a bold dashed line. The route will follow an existing 2m wide footpath in a westerly then southerly then westerly direction for approximately 115m under the railway to point C (5D69402 24658) shown as a dashed line. The route continues along an existing 3m footpath for approximately 53m in a north westerly direction to point D (SD69362 24692) shown as a bold dashed line. From point D (SD69362 24692) the route will continue over the public highway known as Milking Lane for approximately 30m to point F (SD 69340 24708). The width of the footway between point D and point F is 1.5m. The route will leave Milking Lane in a south-westerly direction for approximately 9m to point G (SD69336 24704), the route is 1.5m wide from this point. The route continues for approximately 57m in a north westerly direction to point H (SD69286 24734). The route turns southwest for approximately 23m along the public highway named Milbank Road where it turns northwest crossing Millbank Road. The route then continues in a north westerly direction for approximately 176m where it terminates at the junction of Milking Lane (point I (SD6915124858)).
