Parish Of Kendal) Public Path Diversion And Definitive Map And Statement
Modification Order 2019

On the 4 October 2022 Cumbria County Council confirmed the above order made under Section 119 of the Highways Act 1980 and Section 53 of the Wildlife and Countryside Act 1981. The effect of the order as confirmed is to divert the full width of that section of public footpath no 536260 at Gooseholme Footbridge from GR 351830 492775 and extending 4 metres southeastwards to GR 351834 492773; to run from GR 351830 492775 and extending 21 metres southwestwards to GR 351819 492758 turning southeastwards for 4 metres to GR351822 492755 then northeastwards for 21 metres to GR 351834 492773; the full width of that section of public footpath no 536260 at Gooseholme Footbridge from GR 351875 492751 and extending 35 metres southeastwards to GR 351904 492732; to run from GR 351875 492751 and extending 28 metres south-southeastwards and south-southwestwards to GR 351874 492725 then continuing south-southwestwards for 13 metres to GR 351868 492714; and
the full width of that section of public footpath no 536261 at Gooseholme Footbridge from GR 351880 492748 and extending 7 metres northeastwards to GR 351883 492754; to run from GR 351874 492725 and extending 17 metres northeastwards to GR 351888 492734 then turning north-northwestwards for 21 metres to GR 351883 492754.
The width of the new sections of public footpath will be 3.5 metres.

A copy of the Order as confirmed and map, may be inspected free of charge at Kendal Library, Stricklandgate, Kendal and the offices of the Countryside Access Team, The Parkhouse Building, Kingmoor Business Park, Carlisle CA6 4SJ by appointment only (ref 5.1.443). The order comes into force immediately, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 13 October 2022 make an application to the High Court.
NOTICE is also given that an Agreement has been entered into under Section 25 of the Highways Act 1980 the effect of which will be to upgrade the whole length of public footpath nos 536260 and 536261 to public bridleways; and add a section of public footpath no 536277 at Gooseholme Bridge from its junction with public path no 536260 at GR 351875 492751 northeastwards and eastwards for about 17 metres via 14 steps to meet public path no 536261 at GR 351887 492761. The width of the new path will be 2 metres. There is no right of objection and the Agreement has taken immediate effect. A copy of the map referred to in the Agreement under Section 25 of the Highways Act 1980 will also be available for inspection as detailed above.
