A RAPIST who filmed himself attacking a woman as she lay sleeping beside her husband has been jailed for six years.

Daniel Smith, now of Carlisle, struck after being allowed to stay overnight at the couple's home in south-west Scotland in January 2020.

The 31-year-old denied the crime at a trial last month, but was convicted of rape following a trial.

Smith was today sentenced at the High Court in Glasgow.

Lord Beckett told him: "The effect of this on the woman has caused her serious difficulties and changed the way she leads her life.

"You had been provided with a comfortable bed, but instead you crept around the house.

"You initially molested a sleeping woman as she lay beside her husband.

"What is most concerning is you filmed and photographed what you did.

"You raped the woman until they awoke and you were ejected from the house."

Smith - who showed no emotion as he was sentenced - was put on the sex offenders list indefinitely.

The court heard how it was agreed sex occurred that night, but that the predator maintains it was not rape.

Iain Smith, defending, told the hearing: "He is in some shock at the potential consequences of his conviction in terms of the sentence that will be imposed."

It emerged Smith had previously been fined for a domestic assault.
