Notice of public consultation on proposed changes to an accepted application for a Development Consent Order

Regulation 20 of The Infrastructure Planning
(Environmental Impact Assessment) Regulations 2017

An application for a development consent order ("the DCO application") was submitted by National Highways Id the Secretary of State c/o the Planning Inspectorate on 21 June 2022 and was accepted for examination on 19 July 2022. The reference number applied to the DCO application isTR010062.

Notice is hereby given that National Highways Limited of Bridge House, 1 Walnut Tree Close, Guildford, GU1 4LZ ("the Applicant") is holding a public consultation on potential changes ("the proposed changes"), before making an application for some or all of the proposed changes to be included in the examination of the DCO application as submitted.

The consultation includes environmental information arising from the proposed changes that relates to the Environmental Statement submitted in support of the DCO application. National Highways is treating this environmental information as if it were "further information" as defined by the Infrastructure Planning (Environmental Impact Assessment) Regulations 2017.

Some of the proposed changes on which National Highways is now consulting would involve changes to the land requirements in the DCO application as submitted. Where additional land is proposed to be used or acquired compulsorily for any of the proposed changes, a request for the authorisation of compulsory acquisition powers may be necessary.

Summary of the Project
The DCO application is for an order which would authorise the construction, operation and maintenance of the dualling of all the remaining single lengths of carriageway of the A66 to create a continuous 70mph dual carriageway (with the exception of a short length of 50mph dualling between M6 Junction 40 and east of Kemplay Bank) across the North Pennines, between the M6 motorway and A1 (M) junctions, including improvement of these two junctions, ("the Project"). In summary the Project comprises eight schemes with the following main features:

• Online widening (adjacent to the existing road) of the carriageway and improvement to junctions within these lengths of the widened route

• Offline construction (new lengths of road following different routes but reconnecting into existing lengths of the A66 that are already dualled) including new junctions to connect to the local road network

• Improvement to and the construction of new cycleways, footpaths and bridleways

• Ancillary or related development, including works associated with the tie-in of the authorised development; street works, relocation of new road traffic signs, signals, street lighting, road restraints and carriageway markings; works to alter, remove or maintain street furniture or apparatus; works to facilitate traffic management, provide vehicle recovery services and to deliver information relating to the authorised development; and works to stop up, provide or re-provide private means of access to land or premises

• All schemes (with the exception of the A1 (M) Junction 53 Scotch Corner scheme) include lengths of de-trunked A66 as a result of the Project

The DCO would authorise the compulsory acquisition of land, interests in land and rights over land, and the powers to use land permanently and temporarily for the construction, operation and maintenance of the project.

The DCO would make provisions in connection with several ancillary matters, including the permanent construction and alteration of streets, the temporary interference with and the permanent stopping up of streets, public rights of way and private means of access in the vicinity of the Project and the classification of roads all included within the Project, the de-trunking (i.e. removal of trunk road status) of part of the existing A66, along with the amendment, disapplication and modification of relevant legislation.

The works proposed to be authorised by the DCO are environmental impact assessment development for the purpose of the Infrastructure Planning (Environmental Impact Assessment) Regulations 2017 and accordingly an Environmental Statement accompanied the DCO application.

Summary of the Proposed Changes
National Highways considers that the majority of the proposed changes on which it is consulting are minor in the context of the Project as a whole and are non-material, with a small number of the proposed changes potentially being material. National Highways is of the view that collectively the proposed changes would not materially change the substance of the relevant scheme (within the Project) to which they relate, and which has previously been consulted on; and nor would they materially change the nature of the Project as a whole.

Environmental Information
National Highways has reviewed and appraised each of the proposed changes in the context of the likely significant environmental effects previously reported in the Environmental Statement submitted in support of the DCO application, to ascertain whether any of the proposed changes, either individually or cumulatively, would give rise to any new or different likely significant effects, beyond those previously reported in the Environmental Statement.

The outcome of this work for each proposed change, and therefore the environmental information which National Highways is consulting on at this time, is summarised in the Proposed Changes Consultation Brochure, with further details set out in an Appendix to the Brochure, which reports where National Highways considers, whether evaluated individually or collectively, the proposed changes could result in any new or different likely significant environmental effects beyond those already assessed and reported in the Environmental Statement submitted in support of the DCO application.
