PUBLIC PATH DIVERSION AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2022
On the 8 November 2022 Cumbria County Council confirmed the above order made under Section 119 of the Highways Act 1980 and Section 53 of the Wildlife and Countryside Act 1981. The effect of the order as confirmed is to divert the full width of that section of public footpath no 526009 situate at Spring Bank in the parish of Grange over Sands from GR 339753 478206 eastwards for about 112 metres to GR 339862 478201; to run from GR 339753 478206 northeastwards and eastwards for about 124 metres around the edge of the field to GR 339861 478251 then across a tarmac drive for about 8 metres to GR 339869 478249 and then turning southwards for about 53 metres to GR 339862 478201. The width of the new path will vary from 1.2 metres to 3 metres.
A copy of the Order as confirmed and map may be inspected free of charge at Grange Over Sands Library, Grange Fell Rd, Grange-over-Sands LA 11 6BQ and the offices of the Countryside Access Team, The Parkhouse Building, Kingmoor Business Park, Carlisle CA6 4SJ by appointment only (ref 5.2.490). Details of the Order are available to view on the County Council's website and copies of the Order may be purchased at a cost of £2 per A4 sheet and £3 per A3 sheet. The order comes into force on 10 November 2022, but if a person aggrieved by the order wants to question its validity, or that of any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980, as amended, or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act, within 6 weeks from 10 November 2022 make an application to the High Court.
